OPT OUT

Opt your children out of ANY and ALL surveys, analyses, questionnaires, and evaluations. This type of questioning of your student holds zero educational value. Schools use the information they collect about the student (and their parents) to provide to groups such as for-profit curriculum “developers', social media companies, and outside special interest groups.

Once sent, no further explanation is needed! We would suggest sending the email as a read receipt so you have proof that the school district, teacher, and school principal received the email. If you do not send it as a read receipt requested, please consider sending it via signature required to your superintendent of the school and then follow up by emails with individual teachers and principals.

Below are samples of notices to be sent to your child's school to opt them out of certain activities.

POLICY ILD

Some school districts have Policy ILD - Educational Research: Student Surveys, Analyses, Questionnaires, and Evaluations. One could utilize this policy to opt-out of students. One email to your child's school protects the child from surveys for an entire school year.

PROTECTION UNDER

FEDERAL LAW

Federal Law 20 USC 1232h: Protection of Pupil Rights states: (b) Limits on survey, analysis, or evaluations.

No student shall be required, as part of any applicable program, to submit to a survey, analysis, or evaluation that reveals information concerning-

(1) political affiliations or beliefs of the student or the student's parent;

(2) mental or psychological problems of the student or the student's family;

(3) sex behavior or attitudes;

(4) illegal, anti-social, self-incriminating, or demeaning behavior;

(5) critical appraisals of other individuals with whom respondents have close family relationships;

(6) legally recognized privileged or analogous relationships, such as those of lawyers, physicians, and ministers;

(7) religious practices, affiliations, or beliefs of the student or student's parent; or

(8) income (other than that required by law to determine eligibility for participation in a program or for receiving financial assistance under such program), without the prior consent of the student (if the student is an adult or emancipated minor), or in the case of an unemancipated minor, without the prior written consent of the parent.

SEL (Social Emotional Learning)

Opt your child out of ANY and ALL Social/Emotional “learning” programs/curriculum and ANY and ALL school counseling “curriculum” and school counselor “services”. Studies have shown that this type of curriculum does not improve students' understanding of Math, Science, Social Studies, or Language Arts. In fact, the studies are now indicating that toxic positivity, non- age-appropriate health curriculum, and trauma-responsive curriculum are having a negative effect on children's ability to learn. Some school districts have Policy IMBB (or a similar call sign) Exemption From Required Instruction (specifically as it relates to Teaching About Controversial/Sensitive Issues.) The policy reads in part: “The Board recognizes, however, that there could be topics in the curriculum which may be objectionable to individual students and/or parent(s)/legal guardian based on their particular sincerely held religious or philosophical beliefs. Exemption from instruction which infringes on such beliefs may be requested by the parent(s)/legal guardian. Requests for exemption from instruction must be made in writing to the building Principal and are subject to the approval of the Principal. The Principal will notify the Superintendent as soon as practicable of any request for exemption from instruction and of his/her decision. If the Principal denies an exemption request, the parent(s)/legal guardian may appeal to the Superintendent.”

FEDERAL RIGHT TO INSPECT INSTRUCTIONAL MATERIAL

School districts are not telling parents that under Federal Law USC 20 1232 they have a RIGHT to inspect instructional material, excluding academic tests or academic assessments, used by an LEA as part of the educational curriculum for a student. (Regardless of format or context.) If you are denied after your request to inspect the instructional material, you can send a response stating under Federal Law.

However, the likelihood of any school district handing over all of the instructional material used by school counselors or Social/Emotional Learning is slim. They would be forced to either expose the curriculum or quietly allow you to opt-out your child.

LIBRARY MATERIALS

Opt your child out of Library “materials” including teacher's classroom library “materials” which are objectionable.

As a parent, you have the right to determine what reading materials are suitable for your child. Parents can utilize Policy IMBB and/or Federal Law USC 20 1232 to protect their children from gaining access to “library materials” that the parents do not find suitable for their child.

OBSCENITY

INFORMATIONAL:

Is it LEGAL for Public Schools in Maine to disseminate Obscenity to minors?

The stunning answer is YES! Yes, it is legal.

Maine Law Title 17: CRIMES- Chapter 93-A: OBSCENITY Subsection §2911. Dissemination of obscene matter to minors- ALLOWS for the dissemination of obscene matter to minors under the guise of “art” or “educational purposes”. Per the law- “Section 2. General rule. A person is guilty of disseminating obscene matter to a minor if he knowingly distributes, or exhibits or offers to distribute or exhibit to a minor, any obscene matter declared obscene, in an action to which he was a party, pursuant to subsection 3.

A. This section shall not apply to any noncommercial distribution or exhibition for purely educational purposes by any library, art gallery, museum, public school, private school or institution of learning, nor to any commercial distribution or exhibition by any art gallery or museum.”
